Bankruptcy is a legal term declaring the inability to pay current debts

The legal term bankruptcy declares the inability or impairment of ability of an individual or organisation to pay their creditors. Creditors may file a bankruptcy petition against a debtor which is known as "involuntary bankruptcy" in an effort to recoup a portion of what they are owed. However with the majority of cases, bankruptcy is initiated by the debtor, which is known as "voluntary bankruptcy", which is where you are basically declaring yourself bankrupt.

Bankruptcy should only be considered when there really is no option or any possible way to pay off your debts. Your assets are shared out amongst your creditors as a way of repaying what you owe. With bankruptcy you will lose control of all your assets and you will be unable to gain credit, you will not be permitted to become a company director and you will not be able to take part in the promotion, formation or management of a limited company without gaining permission from the court first. You will also not be able to trade in any business under any other name without informing them that you are bankrupt, you also can’t continue as an accountant or lawyer and you may not become of member of a local authority or parliament.
